It is customary at the beginning of the year for the Water Authority to begin calculating a fixed fee for water services. Information about its amount is given to any entity that has a final water law decision.
And also everyone has the right to file a complaint if they disagree with the amount of the fee charged. This is indicated in Article 273 of the Water Law. A complaint shall be submitted to the Director of the Water Board within 14 days of receiving information about the fixed fee. Waterways also has 14 days to review it.
If the complaint is legitimate and accepted by the Water Authority, the entity will receive another information, including the amount and method of calculating the water service fee, and then, within 14 days of its transmission, the authority will refund the difference between the amount of the originally calculated water service fee and that resulting from the complaint.
In the event of an unsubstantiated complaint, the Director of the Water Board shall determine the amount of the water service fee by decision. Then, if you still disagree with the amount set, you have the right to complain to the administrative court.
Importantly, filing a complaint does not stop the need to pay the fee to the Water Authority’s account, and is entitled only once during the entire billing period.
